Osaka Solutions respects your privacy. Whether you are purchasing one of Osaka Solutions' quality products or simply browsing the Osaka Solutions websites, Osaka Solutions wants you to feel comfortable with our privacy policy and the security measures we take to protect your personal data.

If you provide Osaka Solutions with personal data or we collect personal data about you from other sources, Osaka Solutions will handle it in accordance with this policy. Osaka Solutions encourages you to read this privacy policy in its entirety.

General principles for the processing of personal data


To ensure that your personal data is processed correctly and with an adequate level of data protection, Osaka Solutions has adopted the following processing principles:

  • Personal data is collected only for specific, explicit, and legitimate purposes and is not processed in a manner incompatible with those purposes.
  • Personal data shall be adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.
  • Personal data will be accurate and, if necessary, will be kept up to date, and incomplete or incorrect personal data will be rectified or deleted, or processing will be suspended.
  • Personal data will not be kept in a form that allows the identification of subjects for longer than necessary for the purposes for which the data was collected or for which it will be processed subsequently.
  • Personal data will be processed in a manner that ensures the appropriate security of personal data.

Osaka Solutions will always inform you about the collection and processing of your personal data unless we have a legitimate reason not to do so.


Types of personal data

We will collect and process your personal data in various ways when you interact with us through the different existing channels.

It is necessary to process some personal data so that we can provide you with the services you have requested and some personal data that you may choose to provide voluntarily. We will always inform you which personal data is required (for example, by using an asterisk (*)) and the consequences of not providing us with such data, for example, will be that we will not be able to (fully) fulfill your request.

The personal data that we collect and process can generally be divided into the following categories:

  • Contact information such as name, address, phone number, email address, title, workplace, etc.
  • Information you provide when contacting us through web contact forms, online chat, emails, or phone.
  • Profile information in case you create a profile or an account with us, including the username and password.
  • User information, such as technical data about usage and viewing, including IP addresses when visiting our websites or applications, even on third-party sites.
  • Transaction information, including credit card information when you purchase our goods or services.
  • Smart metering information, measurement of heating, cooling, water, and other utility consumption.
  • Application information, including your CV, in case you apply for a job at Osaka Solutions. You will receive separate information about the processing of personal data regarding this when you submit your application.
  • Information received through our direct lines.

As a general rule, we will not process any special category of personal data (special personal data) about you unless you have provided your explicit consent or we are required to do so to comply with applicable regulation.

Our purposes for processing your personal data

We only process your personal information to achieve a legitimate purpose and, in general, we will only process your personal information if:

  • You have given your consent for such processing;
  • Processing is necessary for the execution of a contract;
  • The processing is necessary to comply with a legal obligation to which we are subject;
  • The processing is necessary for the purposes of the legitimate interests we pursue or a third party, and such processing is not considered harmful to you.

We process your personal data for the following purposes:

  • To provide you with products, services, and information that you request;
  • To send newsletters or other marketing materials, including surveys;
  • Manage our business relationships and negotiate and execute agreements;
  • To provide general customer service and support;
  • To obtain customer information and knowledge of how our various services, including websites and applications, and products are used, as well as the evaluation and improvement of them;
  • To communicate with you regarding various matters;
  • To complete investigations of reports filed by you through our whistleblower system;
  • Comply with any applicable law.

The purposes of processing the data collected through the use of cookies are as follows:

  • To operate, improve, and optimize the performance and user experience of the website and its services,

Use of your personal data at Osaka Solutions

Osaka Solutions, with which you are a client and with whom you contact or enter into an agreement, will be the data controller regarding the personal data processed about you. However, to pursue the purposes listed above in section 3, we may share your personal data with other entities of the Osaka Solutions group to carry out a task according to the instructions of the data controller (recipient acting as a data processor) or to pursue a legitimate purpose of its own (recipient acting as individual data controller), provided that the availability or disclosure of your personal data is not restricted by law.

Our disclosure and transfer of your personal data to recipients (natural or legal persons, public authorities, agencies, or other bodies to which personal data is disclosed) is kept to a minimum and is subject to the existence of an adequate level of data protection.

We may disclose or make personal data available to recipients under the following circumstances:

  • Recipients who provide services on our behalf, such as e.g. hosting, cloud computing, marketing services, administrative services, training services, or other data processing. Such recipients may only process personal data in accordance with our instructions, and the relationship will be governed by a written data processing agreement;
  • To establish, exercise, or defend our legal rights;
  • If you have given your prior consent for the disclosure of personal data to a recipient
  • In the event of a merger, sale, joint venture, assignment, transfer, or other disposition of all or part of the assets or shares of Osaka Solutions (including, but not limited to, in connection with bankruptcy or similar proceedings)
  • As stated in our cookie policy, cf. the previous section 4.

If the recipient of the personal data is located in a country outside the EU/EEA that does not ensure an adequate level of data protection, we will only transfer your personal data to that recipient after executing a written transfer agreement based on the EU Commission's standard contractual clauses.

Automated individual decisions

We can use automated decisions based on your personal data. Automated decision-making will only take place if the decision is:

  • Necessary to enter into or fulfill a contract between you and Osaka Solutions;
  • Authorized by the legislation of the Union or the Member State to which Osaka Solutions is subject and which also establishes appropriate measures to safeguard their rights and freedoms and legitimate interests; or based on their consent.

If we use automated decision-making, we will ensure that appropriate security measures are implemented.

Special personal data shall in no case be subject to automated decision-making, unless you have provided your explicit consent or the processing is necessary for substantial public interest reasons, in accordance with applicable law.

Your consent

As mentioned earlier, some of our processing activities will be based on your consent. In that case, you will have the right to withdraw your consent at any time.

If you withdraw your consent, we will stop processing your personal data, unless and to the extent that the processing or continued storage is permitted or required in accordance with applicable personal data legislation or other applicable laws and regulations.

Please note that the withdrawal of your consent will not affect the legality of the processing carried out before the withdrawal. Furthermore, as a result of the withdrawal of your consent, we may not be able to fulfill your requests or provide you with our services.

Data security

To safeguard your personal data, Osaka Solutions has implemented appropriate technical and organizational measures to ensure a level of security adequate to the risks represented by the processing and the nature of the personal data to be protected, taking into account the state of the art and the state of the costs of its implementation.

After the risk assessment, Osaka Solutions has taken measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, particularly when processing involves the transmission of personal data over a network, and against all other unlawful forms of processing.

Training

To ensure that we always comply with applicable data protection legislation and to make sure that our employees are familiar with such regulations, we have established an internal privacy training program that our employees are required to complete.

Your rights

You have the right to access the data processed about you, subject to certain legal exceptions. Additionally, you can object to the collection and subsequent processing of your personal data. Furthermore, you have the right to correct your personal data if necessary. You may also choose to request that we restrict the processing.

We will remove or correct any information that is inaccurate or outdated due to the time that has passed since it was collected or due to any other information in our possession.

If you provide us with a written request, we will also delete your personal data without undue delay, unless we have a legal basis to continue processing, if the processing is necessary to establish, exercise, or defend a legal claim or necessary for the performance of a contract with you.

Regarding such requests, please kindly provide us with relevant information to address your request, including your full name and email address so that we can identify you. We will respond to your request as soon as possible and within a month.

If you do not agree with our processing of your personal data, please note that you can file a complaint with your local data protection agency.

We will review and evaluate your claim and, if necessary, we may contact you for more information.

We strive to process any complaint or objection within one month. If it is not possible to make a decision within one month, we will inform you of the reasons for the delay and the time (not exceeding 6 months from receipt) in which you can expect a decision to be provided.

At any time before, during, or after the claims process described above, you may also file a complaint / bring a case before your local data protection agency or other authorities within the jurisdiction of the local entity of Osaka Solutions or Osaka Solutions, S.L..

We reserve the right to modify this Privacy Policy in the future due to changes in applicable legislation or in the processes of Osaka Solutions. We will inform you about such modifications.
